The Association pour la Forêt Vierge (AFV France) in its capacity as Data Controller is particularly attentive to the protection and respect of your privacy. The purpose of this Privacy Policy is to show you how we collect, use and share your Personal Data in accordance with the Regulations. We invite you to read this document carefully in order to know and understand our practices regarding the processing of your Personal Data.

 

1 - Definitions

"Personal Data" or "Data" means any information relating to an identified or identifiable natural person. An "identifiable natural person" is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, Location Data, an online identifier, or to one or more elements specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity;

"Sensitive Data" means Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as the processing of Genetic Data, Biometric Data for the purpose of uniquely identifying a natural person, Data concerning health or Data concerning the sexual life or sexual orientation of a natural person. The Association pour la Forêt Vierge (AFV France) does not process any sensitive data.

"Controller" means the natural or legal person, public authority, service or other body which alone or jointly with others determines the purposes and means of processing data. In this case it is the Association pour la Forêt Vierge (AFV France).

 

"Regulation" means Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (GDPR) and the Data Protection Act No. 78-17 of 6 January 1978 as amended.

"Sites" refers to all websites published by the Association pour la Forêt Vierge (AFV France).

 

2 - The Data we collect

Through our websites, we may collect and process the following Data:

 

2.1 - Data that we collect when you make a donation, a pledge, or register for an event requiring financial participation.

In order to receive your donation, to send you your tax receipt and to keep you informed of the use made of our resources, especially those coming from public generosity, we have to process the following Data:

 

- Identification data: email, title, first name, last name, address, date of birth, telephone number;

 

- Payment data: bank details, credit card number, expiry date, visual cryptogram (This data is processed by payment service providers/contractors but is not kept by the Association pour la Forêt Vierge (AFV France) or by subcontractors).

When you register for an event or contribute to the financing of an event, we also collect the above Data as well as a photograph if you provide us with one.

If you provide us with personal information about a third party, you will be required to provide them with a copy of this Policy.

 

2.2 - The Data we collect when you subscribe to our newsletter or sign a petition

When you subscribe to our newsletter or sign one of our petitions, we collect the following Data:

- Name ;

- First name ;

- Email address;

- Phone number.

These data will allow us to contact you by email, mail, phone or sms to inform you of AFV’s news, to appeal to your generosity and/or to invite you to events.

2.3 - Data that we collect via cookies and other trackers

The site of the Association pour la Forêt Vierge (AFV France) uses cookies installed on your computer during your navigation. A cookie is a small file that records information relating to navigation on a Site. The data obtained in this way is intended to facilitate subsequent browsing on the Site, and is also intended to enable various measures of frequentation. 2.4 - Sensitive Data

The Association pour la Forêt Vierge (AFV France) does not process any sensitive data.

 

3 - Conservation periods

Donor Data will be kept for 6 years after the year of the last donation, in particular to be able to respond to requests from the tax authorities in the event of an audit. During this period, your email address may be used to send you news about the Association, to appeal to your generosity, to invite you to events. Beyond this period, anonymized data allowing the realization of statistical studies will then be kept.

The Data of potential testers will be kept for 9 years after the last action of the testator (letter addressed to the Association pour la Forêt Vierge (AFV France), donation, signature of petition).

The Data of proven testators (having confirmed their wish to bequeath all or part of their assets to the Association pour la Forêt Vierge (AFV France)) will be kept for 10 years after the closure of the estate.

Visitor Navigation Data will be kept for 13 months.

 

4 - Purposes and legal bases on which our processing is based

Each Data processing has a specific purpose and is based on a legal basis.

The purpose of the treatments referred to in 2.1 is :

- The sending of the information letter to the persons having made the request.

- Recording the signatures of individuals in the context of petitions

- Taking into account your registration for an event

- Management of testator relations and follow-up of the treatment of legacies

- Soliciting new donations

- Carrying out charitable prospecting operations

The treatments referred to in 2.1 have a legal basis:

- The execution of the unilateral donation contract

- Compliance with a legal obligation to which the Data Controller is subject

- The execution of the contract (e.g. compliance with the Regulations of an event) and the legitimate interest of AFV

- The legitimate interest of AFV France

 

The treatments referred to in 2.2 have the following objectives:

- The sending of the information letter to the persons having made the request.

- Recording the signatures of individuals in the context of petitions

- The solicitation of these same subscribers or signatories of petition(s) in the context of calls for financial support for the actions of AFV France.

The processing referred to in 2.2 has as legal basis :

- The legal basis for this processing is the legitimate interest of AFV and requires sometimes consent.

 

5 - Recipients of your Data

Your Data can be sent to :

- The "Communication" Services of AFV France to send you our news or requests for donations;

- Our subcontractors in charge of payment operations;

- Our IT service providers;

- Other affiliated entities of AFV

In the event of a reorganization or restructuring, whether contemplated or finalized, certain auditors, advisors, and purchasers may also have access to your Data.

Your Data may also be shared with other associations. You may object to this in the manner set forth in Article 9.

 

6 - Data Transfers

AFV France does not transfer your Data outside the European Union. Nevertheless, it is possible that the Data may be hosted on servers located outside the European Union.

In this case, AFV France undertakes to take all necessary measures to preserve the integrity and security of your Data so that they are :

- located in a State considered adequate by the European Commission 

- sent to entities offering sufficient guarantees as to the protection of Personal Data through the implementation and signature of standard contractual clauses approved by the European Commission.

7 - Security of Processing

AFV France ensures the processing of your Data in complete confidentiality and security by putting in place the technical and organizational measures necessary to preserve in optimal conditions their security, confidentiality and integrity.

Only persons strictly authorized by the AFV will have access to your Data. No unauthorized third party will have access to it, except for the legal obligation incumbent on the Data Controller.

 

8 - Journalists, influencers / users of social networks, experts

AFV may maintain contact information (publicly available) for journalists and people who influence social networks, experts and people who make public their personal or professional information or opinions. These lists are consulted and/or used by AFV to send press releases and advocacy information. The legal basis of this processing is the legitimate interest of the AFV.

 

9 - Your rights

Pursuant to the French Data Protection Act and the European General Data Protection Regulations (GDPR), you have at any time the right to access, modify, oppose commercial prospecting and, if there are legitimate reasons, the right to limit the processing of your Data and the right to request the deletion of your Personal Data. You also have the right to the portability of your Data, the right to define guidelines concerning your Data in case of death and the right to withdraw your consent. You may exercise your rights by writing to communication@foretvierge.org.

If you are not satisfied with the processing of your Data or the exercise of your rights, you have the possibility to refer the matter to the CNIL.

 

10 - Updating

This policy may be updated by the AFV in the event of new treatments, particularly on the basis of :

- significant changes in legislation and/or jurisprudence as well as technical standards applicable to the Information System;

- risk assessment;

- readjustments suggested by the implementation of internal information management procedures.

Our cookie policy

This policy applies to sites published by AFV France (hereinafter the "Site").

 

What is a cookie?
